Waiver of Liability & Consent

I am legal guardian to a child (referred to as “my child”) who desires to participate in an Exploratores, LLC class, camp, mini-camp, or other event (the “Activity”) provided by Exploratores, LLC, a New Jersey limited liability company, located at 219 East Broad Street, Second Floor, Westfield NJ 07090 (the “Company”). By signing below, I, the undersigned, acknowledge and agree to the following:

1. Participation Risk Acknowledgment: I understand that participation in any programs and makerspace activities involves inherent risks, including but not limited to the use of tools, materials, and equipment that may pose potential hazards. Furthermore, I hereby acknowledge that running, climbing on furniture, hanging on structures, jumping, throwing, smashing or any other destructive behavior is strictly prohibited at the Company, and is grounds for immediate removal from the Company’s premises.

2. Waiver of Liability: I understand that the Activity is intended for people ages six and older who are capable of following staff instructions. I am aware and understand that while Exploratores, LLC will take reasonable precautions to avoid and/or minimize the risk of injury, certain activities could potentially include the risk of serious injury and/or death and/or property damage. I acknowledge that any injuries that my child may sustain may be compounded by negligent emergency response or rescue operations of the Company. I acknowledge that I am voluntarily signing up my child to participate in the Activity with knowledge of the potential danger involved and hereby agree to accept and assume any and all risks of injury, death, or property damage, whether caused by the negligence of the Company or otherwise. I hereby release and hold harmless the Company, its owners, employees, and affiliates from any liability, claims, or damages arising out of my child’s participation in any class or activity, except in cases of gross negligence or willful misconduct. Furthermore, I agree that I will not make any disparaging remarks about the Company, its staff or any of its customers, whether orally or in writing, including public defamatory statements that would materially harm the reputation or business activities of the Company or such individual(s).

3. Medical Emergency Authorization: In the event of a medical emergency where we are unable to contact me or the emergency contacts I have provided, I authorize the Company staff to secure necessary medical treatment for my child and I assume responsibility for associated costs.

4. Authorized Pickup Information: To ensure the safety and well-being of all participants, I acknowledge that children will only be released to adults listed as parent/guardian, emergency contact person, and authorized pickup persons on the registration form. If someone not listed on the form will be picking up my child, I understand that I must notify the Company in writing before pickup. Notifications can be sent via email to [email protected]. I will ensure that all authorized pickup persons bring a valid photo ID, as it may be required for verification. By signing this waiver, I acknowledge and agree to these policies.

5. COVID-19 NOTICE: The Company will take reasonable precautions to prevent the transmission of COVID-19. Children will be expected to comply, and caregivers shall be expected to abide by the requirements set forth by local, state and federal health authorities. We reserve the right to ask questions, take temperatures, and require masks to be worn. There is no guarantee that any of these precautions will prevent your child from contracting COVID-19. The Company assumes no liability with regard to any such transmission.

6. Photo/Video Consent and Media release: Security cameras are in use at the Exploratores classroom space. By signing up with Exploratores, I agree to allow the recording of my child while in attendance. I agree with the Company’s policies regarding photographs, videos, social media and security cameras. Photographs, videos, social media and security camera recordings may be used for display/training purposes within the Company or social media posts. By signing this agreement, I, without payment or other consideration, agree to grant the Company permission and a license to take, use, reuse, and publish my likeness and/or my child’s likeness in photographs, videos and/or other electronic and/or digital and printed media in any and all of the Company’s publications, including but not limited to any website entries, advertising websites, social media websites, and any other marketing materials. I understand and agree that these materials will become the property of the Company and will not be returned. I agree to irrevocably authorize the Company to edit, alter, copy, exhibit, publish, and distribute this media for any lawful purpose. I waive the right to inspect or approve the finished product. These terms shall survive any termination of this agreement.

7. Cancellation and Refund Policy:
I acknowledge and agree to adhere to the Company’s cancellation and refund policy as stated on their website or enrollment documentation.
